Conditions for the protection of personal data processed by the LB MINERALS SK, s.r.o. company

1. Our trading company processes personal data willingly provided from our customers (buyers) or provided from our suppliers of goods and services to our company (sellers) - (hereinafter jointly referred to as Partner), which were provided willingly to our company via e-mail, or otherwise, in particular name and surname of buyers, or suppliers or their authorised representatives; in the case of commercial companies represented by a natural person, their address, e-mail, phone number, date of birth, if deemed necessary, as processing of personal data is required for the performance of supply or customer contracts, where the parties thereto are our trading company on one hand and the entities above on the other hand, and/or for the purpose of handling of requests of such entities preceding conclusion of contracts relating to goods or services sold, and for the performance of obligations of our trading company bestowed upon it by generally binding legal regulations. Processing of personal data by our company shall be carried out for the time necessary to exercise the rights and obligations resulting from the contracts above and from the generally binding legal regulations.
2. Any person interested in trade cooperation, or any existing contractual partner of our trade company (hereinafter jointly referred to as Partner) can express their consent to receiving information via e-mail, regarding news or business offers from our trading company, by checking the appropriate box on the website of our trading company at http://www.lbminerals.sk. By ticking this box the Partner being the data subject freely and voluntarily grant their express consent to processing of the email address provided for marketing purposes - transmission of information via e-mail to our trading company within the meaning of the current law on the protection of personal data and of the relevant EU legislation. This potential consent to personal data processing shall be granted by the Partner for a period of 5 years.
3. Consent to the processing of personal data for marketing purposes may be revoked by the Partner at any time by following the respective link located directly in each marketing e-mail from our company, which shall be sent to it or by sending a specific e-mail.
4. Partner in accordance with point 1. or 2. (Hereinafter jointly referred to as Partner) shall be responsible for the completeness, accuracy and correctness of the personal data provided. In the event of a change of personal data the Partner shall be obliged to immediately communicate such change to our trading company, in particular in a way and manner in which it was provided, or to update them directly within its user account, provided such account exists.
5. In the case of the personal data provided not being up to date, of revoking consent to personal data processing following expiration of the purpose or time period for which the consent to the personal data processing had been granted or provided storage thereof should be unacceptable due to any legal reasons, those archived personal data shall be erased.
6. Personal data protection shall be governed by the provisions of law on the protection of personal data and the relevant EU legislation, where rights of data subjects are also stipulated. Partner has the right to free provision of information concerning processing of their stored data. Provided that the requirements laid down in the generally binding legal regulations are adhered to, the Partner shall also have (i) the right of access to their personal data, (ii) the right to rectify inaccurate personal data, (iii) the right to limit (block) processing of the personal data, (iv) the right to object to processing of personal data, (v) the right for erasing personal data, in particular if those are no longer necessary for the purposes for which those were obtained or otherwise processed, or if it revoked their consent to processing thereof, and if there is no other legal basis for processing, or if the personal data was processed illegally.
7. In the event that any Partner is exercising their rights of a data subject towards our trading company under the legislation governing personal data protection and it is not possible to verify the identity of the applicant directly from their application, or, in the case that our trading company has justified doubts in connection with the identity of the person filing such request, our trading company shall reserve the right to ask that person to provide additional information necessary to confirm the identity of the person filing such request.
8. As the data subject the Partner shall have the right to lodge a complaint with supervisory authority, which is the Office for personal data protection, registered office Hraničná 12, 820 07 Bratislava, when there is a suspicion that their personal data are processed in breach of the legislation in force.
9. Our trading company declares that personal data is only processed for the purposes described above and in accordance with the law on the protection of personal data and the relevant EU legislation, and with the use of appropriate technical, organizational and security measures.
10. Personal data of any Partner may be made available to a third person (recipient), where it is deemed necessary for performance of a contract, particularly within the scope of purchase order processing and contracts implementation, where those may be provided to the extent necessary to service providers of trading company, such as carriers, banks and the like. Such data may be used by these service providers exclusively for the purposes of performance of contract.
